1. Payments and Refunds

All monies paid are subject to the cancellation and refund provisions set out in these Terms & Conditions.

Refunds will be provided where:

• a person included in the booking dies;
• changes to government regulations or official restrictions prevent the programme from taking place; or
• the programme is cancelled by the hotel or Hotel Breaks 4U.

Nothing in these Terms & Conditions affects any statutory rights that may apply under applicable law.

2. Changes, Cancellations and Transfers

Where a person changes their mind after payment has been made, or wishes to cancel their booking for any other reason, they may, more than 8 days before the first day of the event, transfer their booking to another person by notifying Hotel Breaks 4U.

The person taking over the booking must meet any applicable booking requirements. Hotel Breaks 4U must be notified of the change before the transfer takes place.

Where a transfer to another person is not possible, a cancellation charge of €50 per room will apply, subject to the cancellation provisions set out in these Terms & Conditions.

Alternatively, the full amount paid may be transferred to another Hotel Breaks 4U event, subject to availability and any difference in price.

3. Deposits

Where a deposit is specifically required for an event due to limited room availability, the deposit is non-refundable and non-transferable, except where otherwise required by applicable law or where the event is cancelled by the hotel or Hotel Breaks 4U.

Where an event requires a deposit, this will be clearly stated at the time of booking.

4. Cancellation Within Seven Days of Arrival

Cancellations made more than 7 days before the arrival date, excluding the day of arrival, will be subject to a charge equivalent to the cost of the first night’s accommodation.

Any amount paid in excess of the first night’s accommodation charge will be refunded to the client.

Cancellations made within 7 days of the arrival date will be subject to a charge equivalent to the full cost of the first night’s accommodation. Any amount paid in excess of this amount will be refunded to the client.

No-shows and cancellations made on the day of arrival are non-refundable.

These cancellation provisions are subject to any statutory cancellation rights that may apply under applicable law.

5. Final Balance

Where the final balance has not been paid by the stated due date, Hotel Breaks 4U reserves the right to cancel the booking.

In such circumstances, any deposit paid may be forfeited in accordance with these Terms & Conditions.

6. Hotel Breaks 4U’s Role

Hotel Breaks 4U acts as a booking agent and intermediary between the client and the relevant hotel or accommodation provider.

The hotel or accommodation provider is responsible for the provision of the accommodation, facilities and services advertised and included in the booking.

Hotel Breaks 4U is responsible for accurately processing and communicating booking information provided by the client and confirmed by Hotel Breaks 4U.

Hotel Breaks 4U is not responsible for the acts, omissions, standards, facilities, services or policies of the hotel or accommodation provider, except where the issue arises directly from an error or negligence by Hotel Breaks 4U.

7. Booking Errors

Where Hotel Breaks 4U has been negligent or has supplied incorrect booking information to a hotel or accommodation provider, where the correct information was provided by the client in writing and subsequently confirmed by Hotel Breaks 4U, Hotel Breaks 4U will take reasonable steps to rectify the error.

Where the error cannot reasonably be rectified and Hotel Breaks 4U is responsible for the error, compensation may be provided in respect of the affected part of the booking, subject to applicable law.

8. Liability

To the extent permitted by applicable law, Hotel Breaks 4U’s liability in relation to a claim arising directly from a booking error by Hotel Breaks 4U will be limited to the amount paid by the person making the claim for the relevant booking.

Hotel Breaks 4U will not be liable for any loss, damage, injury, inconvenience, additional expense or other claim arising from the acts or omissions of the hotel or accommodation provider, except where such liability arises directly from the negligence or error of Hotel Breaks 4U.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

9. Third-Party Information and Programme Changes

Hotel Breaks 4U may rely on information supplied by hotels, entertainers, performers and other third-party suppliers.

Hotel Breaks 4U is not responsible for information supplied by a third party where that information has been relied upon in good faith and was not known, or could not reasonably have been known, to be incorrect.

Hotel Breaks 4U cannot guarantee that advertised entertainers, performers, hosts or other programme participants will remain unchanged where changes arise from circumstances beyond our reasonable control.

Where a programme change is necessary, Hotel Breaks 4U will endeavour to provide a suitable replacement or alternative where reasonably possible.
